married in the U.S (to someone who isn’t a U.S citizen) he is now in another country (divorce)?

I am a U.S citizen & 4 years ago i married a Costa Rican man in the U.S.A, (he was not a U.S citizen if that makes a differance) we then went to Costa Rica together but while we were there, he had a major affair. i have moved back to the U.S.A a week ago today & i want a divorce. he is still in Costa Rica. he asked me not to tell him if i divorced him once i came back to the U.S.A. is there any special proceedings? will he need to sign something even though he is overseas? we were married in the U.S.A (Georgia) so it is under our laws. i can just go to the court house & get the paperwork & get the divorce without his signature. i will be checking infidelity in this case. any advice?

Almost every state has procedures for an abandoned spouse to divorce. The same laws apply to a spouse that has moved abroad. No signature or agreement from the missing spouse is necessary.

You will need to contact a family attorney to handle this for you.

And by all means, send your husband a copy so he can’t re-new his green card again as a resident spouse.
